Shelby Takedown Policy Private Beta

Introduction

The Shelby Protocol private beta service (“Private Beta”) is a hosted pre-release data service operated by Shelby Labs (“Shelby,” “we,” or “us”) that utilizes a private, permissioned instance of the Aptos blockchain as part of its internal architecture. Shelby has adopted this takedown policy (the “Policy”) to describe how to submit requests to remove or disable access to content that users store on the Private Beta pursuant to applicable law. It also describes how we may act on content that violates the law, whether or not we receive a request. We respond to three kinds of requests, each covered in its own section below:

  • Section 1: copyright infringement, under the U.S. Digital Millennium Copyright Act (DMCA).

  • Section 2: court orders and other legal process.

  • Section 3: other content that violates the law.

When we receive a valid request, or otherwise become aware of content that violates the law, we may disable access to or remove the content, or take other action we consider appropriate. We may keep limited information about the request and the content to administer this Policy and to comply with the law. We may reject incomplete or non-compliant submissions, and we will otherwise act in accordance with applicable law.

Section 1: Copyright Infringement (DMCA)

The DMCA is a U.S. federal copyright statute that protects certain intellectual property rights. The DMCA provides a notice-and-takedown process for reporting copyright infringement by users of the Protocol. The processes include a method of reporting infringements called takedown notices, and a process for disputing those notices, called counter-notices. The DMCA is intended to protect us from liability for users’ infringement when we follow the process it describes, and to make those who abuse that process liable for the harm they cause. It is our policy to respond to valid copyright takedown requests under the DMCA (17 U.S.C. § 512).

How to submit a request.  To ask us to disable access to material you believe infringes your copyright, submit a Copyright Takedown Request Form, available at https://forms.gle/CahwngoJAaVDEUKm6 Only the copyright owner, or someone authorized to act on the owner’s behalf, may submit a request.

Before you submit.  Please consider whether the use is permitted by law.  Courts in the United States have found that you must consider copyright defenses, limitations, and exceptions, including fair use. You may be liable for damages, including costs and attorneys’ fees, under 17 U.S.C. § 512(f), if you knowingly misrepresent that material is infringing. If you are unsure whether material infringes your copyright, we suggest you first consult an attorney.

What happens next.  If we disable access in response to a valid request, we will try to notify the affected user. That user may submit a counter-notice.

Counter-notice.  If you believe your content was disabled as a result of a mistake or misidentification, you may submit a Copyright Counter-Notice Form, available at https://forms.gle/jFYgmP4kijXLXZgx5. If you submit a valid counter-notice, we may forward it to the requester. Unless the requester notifies us that they have filed a court action relating to the content, we may restore access no fewer than 10 and no more than 14 business days after we receive your counter-notice.

Section 2: Court Orders and Other Legal Process

We respond to valid court orders, statutory notices, and other legal mandates that require us to disable access to, or stop storing, content on the Protocol.

How to submit.  Send the order or other legal process, together with information sufficient to identify the content at issue (such as the Source webpage URL or transaction hash), to submit your request to shelbynotices@aptoslabs.com . 

Section 3: Other Unlawful Content

We may also act on content stored on the Protocol that violates other applicable laws.

How to submit.  To report such content, contact us at [https://forms.gle/acBjEKZRgeAohmH66]  with information sufficient to identify the content. We will review the report and respond as we consider appropriate and as required by applicable law.

Repeat Infringers

We have adopted, and will reasonably implement, a policy of terminating, in appropriate circumstances and in our sole discretion, the accounts of users who are repeat infringers. We may also limit a user’s ability to store additional data on the private beta version of the Protocol.
